Terms of Service

By accessing or using MintMerchs (the "Service"), operated by Arcy SAS, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

MintMerchs is a platform that helps you create, configure, and run autonomous e-commerce shops with AI-assisted teams. The Service includes tools for brand and storefront creation, catalog management, growth workflows, and integrations with third-party services such as payment, analytics, and marketing providers.

MintMerchs is offered on a credit-based model with free and paid subscription tiers. Features, limits, and pricing are described in-product and on mintmerchs.com. We may add, change, or remove features over time.

You must be at least 18 years old to use the Service. You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

4.1 Subscriptions and credits

The Service offers a free tier with limited credits and paid plans that include monthly credit grants and additional capabilities. Payments are processed through Stripe or other payment providers we designate. By saving a payment method, you authorize us to charge it for subscription fees and any usage-based charges described in your plan, on the schedule shown in-product, without requiring separate confirmation for each recurring charge. Subscriptions renew automatically until canceled.

4.2 Shop and customer payments

If you use the Service to sell products or accept payments from your own customers, you remain the merchant of record for those transactions unless we expressly agree otherwise in writing. Customer payments may be processed by Stripe or other providers under their terms. You are responsible for taxes, fulfilment, refunds to your customers where required by law, and compliance with applicable commerce rules. Disputes and chargebacks relating to your sales may affect your account balance or access to payment features.

4.3 Service communications

By using the Service, you consent to receive operational messages related to authentication, account activity, billing, credit usage, agent or workflow notifications, and other platform events. These are service messages, not marketing emails, unless you separately opt in to marketing communications where offered.

5.1 No refunds

All sales are final. Due to the nature of our digital service, Arcy SAS does not offer refunds for any subscription fees, credit purchases, or other payments made for the MintMerchs platform, except where required by applicable law or as stated in Section 5.3 below.

5.2 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. No partial refunds are issued for the remaining billing period. Unused credits are not forfeited upon cancellation: you retain access to credits already granted until they are consumed or expire according to your plan terms in-product.

5.3 Exceptions

In cases of billing errors or unauthorized charges, please contact us at [email protected] and we will review your case.

You agree not to:

• Use the Service for any unlawful purpose or in violation of third-party rights.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use autonomous agents or generated content to harm, harass, defraud, or deceive others.
• Upload or distribute malware, spam, or content that is illegal, infringing, or abusive.
• Interfere with or disrupt the integrity, security, or performance of the Service.
• Reverse engineer or scrape the Service except where permitted by law.

7.1 Platform IP

The Service, its software, branding, and underlying technology are owned by Arcy SAS or its licensors and are protected by applicable intellectual property laws. You retain ownership of content and materials you upload or create, subject to the license you grant us to operate the Service.

7.2 AI-generated outputs

The Service uses third-party AI models to generate text, code, images, layouts, and other outputs. AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing all outputs before publishing, selling, or relying on them. As between you and Arcy, you may use outputs created for your shop subject to these Terms and any restrictions imposed by underlying model providers. We do not guarantee that AI outputs will meet any particular quality, legal, or commercial standard.

To the maximum extent permitted by law, Arcy SAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of profits, revenue, data, or business opportunities. MintMerchs does not guarantee sales, traffic, or business results. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

We may suspend or terminate your access to the Service if you breach these Terms, create risk for us or other users, or where required by law. You may cancel your account at any time through account settings or by contacting us. Upon termination, your right to use the Service ends immediately, subject to any data retention described in our Privacy Policy.

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service. The updated date at the top of this page indicates the latest revision. Continued use after changes take effect constitutes acceptance of the revised Terms.
